There are a number of migration options for fiance(e)s, partners, children, parents and other family members of Australian citizens, Australian permanent residents or eligible New Zealand citizens.

Partner Visa Options

Partners of Australian citizens, Australian permanent residents or eligible New Zealand citizens may apply to enter and/or remain permanently in Australia. Partners include:

 Spouse (inc. defacto relationship)

For people from overseas to enter and stay in Australia with their partner, who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. If two years after you apply the spousal relationship is ongoing, a permanent visa may be granted

 Interdependency

For people from overseas to enter and stay in Australia with their partner, who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. If two years after you apply, the interdependent relationship is ongoing, a permanent visa may be granted. This visa is generally for people in a same sex relationship

 Prospective marriage (fiancee)

For people from overseas to enter Australia, marry their fiance(e), who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Once married, holders of this visa can then apply to remain permanently in Australia.

Child Visa Options

Child

For children from overseas who are natural, adopted or step children of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Orphan Relative

For children from overseas whose parents are deceased, permanently incapacitated, or whose whereabouts are unknown and who have an eligible sponsor.

Adoption

For children from overseas who have been or about to be adopted by an Australian citizen, the holder of an Australian permanent visa, or an eligible New Zealand citizen.

Dependent Child Visa

For children whose parent holds a temporary partner visa and is in the process of obtaining a permanent partner visa.

Parent Visa Options

Parent (Permanent) (Subclass 103)

 A permanent visa for parents who have children living in Australia. Applicants for this visa can be of any age, Applicant must meet Balance of Family test. Visa numbers severely capped

Aged Parent (Permanent) (Subclass 804)

 A permanent visa for aged parents to remain in Australia. Applicants must have children who are living in Australia. must be ‘aged’, i.e. old enough to receive age pension under Social Security Act (Aged in Australia is considered the age you are eligible for the pension in Australia which is 65 for men and varies for women depending on their birth date generally this would be 60). Applicant must meet Balance of Family test. Visa numbers severely capped

There are two temporary visas and two permanent visas:

Contributory Parent (Temporary)(173) visa

This is a temporary visa valid for two years. If you hold this visa you can then apply for the permanent Contributory Parent visa.

Contributory Aged Parent (Temporary)(884) visa

This is a temporary visa valid for two years. If you hold this visa you can apply for the permanent Contributory Aged Parent

Contributory Parent (Migrant)(143) visa

Permanent visa for parents with children living in Australia. This visa costs more than the Parent visa but is generally processed faster

Contributory Aged Parent (Residence)(864) visa

A permanent visa for aged parents with children living in Australia. This visa costs more than the aged parent visa but is generally processed faster

Other Visas

Aged dependent relative

Old enough to receive age pension under the Social Security Act, Is a relative of the Australian sponsor, Is either single, widowed, divorced or formally separated, Is, and has been for a reasonable period, dependent on the Australian sponsor, Note aged parents who do not meet the Balance of Family Test but who are single, widowed, divorced or formally separated may be eligible for this visa. Visa numbers severely capped

Remaining relative

All parents/step-parents, adult children, brothers/sisters, and stepbrothers/stepsisters are usually resident in Australia In-laws are included (if married) & Includes child adopted oversea. Restrictions on sponsorships for Remaining Relative visas if the sponsor was previously granted a Remaining Relative vis. Visa numbers severely capped

Carer Visa

Australian citizen, permanent resident, or eligible NZ citizen usually resident in Australia who has a medical condition (physical or mental) & Is prevented from attending to practical aspects of daily life because of it & Will require direct assistance to the attendance of practical aspects of daily life for at least 2 years. And the sponsor has an overseas relative. The overseas relative is willing and able to provide required assistance. Then that overseas relative is the ‘Carer’

Orphan relative Visa

This visa is for children under 18 years of age whose parents are unable to care for them. It allows the child to travel to and live in Australia with an Australian relative.
